These Terms of Service ("Terms") govern your use of PitchIQ (the "Service"), operated by MinMax Technology LLC (the "Company"). By accessing, creating an account for, subscribing to, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least twenty-one (21) years of age, or the minimum legal age required in your jurisdiction, and legally capable of entering into a binding agreement. You are responsible for ensuring your use of the Service is lawful where you reside.
PitchIQ is an informational analytics platform. The Service provides statistical projections, historical analysis, sportsbook line comparisons, and related analytical content for informational and entertainment purposes only. PitchIQ is not a sportsbook, does not accept or facilitate wagers, and does not provide gambling services.
Nothing provided by PitchIQ constitutes betting, gambling, financial, investment, tax, legal, or other professional advice. All decisions remain solely your responsibility.
All projections and statistical outputs are estimates based on available information. The Company does not guarantee the accuracy, completeness, availability, reliability, profitability, or future performance of any projection, model, edge, sportsbook line, or analysis.
PitchIQ relies on third-party providers for statistics, schedules, sportsbook odds, weather, injuries, and other external information. The Company is not responsible for inaccuracies, delays, outages, or omissions from third-party sources.
You acknowledge that use of the Service involves risk. You alone are responsible for your wagers, bankroll management, decisions, compliance with applicable laws, and any financial or non-financial consequences resulting from your use of the Service.
You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account. Notify the Company promptly of unauthorized access.
Paid subscriptions automatically renew until canceled. Charges are billed to your selected payment method. Canceling prevents future renewals, and access continues through the end of the current billing period. Subscription pricing may change with reasonable advance notice before renewal.
The Company strives to provide reliable access but does not guarantee uninterrupted availability. Maintenance, upgrades, outages, security events, or third-party failures may temporarily affect the Service.
You may not share accounts, scrape or harvest data, reverse engineer the Service, copy or redistribute proprietary content, create derivative works, or use automated tools to access the Service without authorization.
All software, projections, statistical methodologies, confidence scores, databases, reports, graphics, branding, trademarks, and other content provided through PitchIQ remain the exclusive property of MinMax Technology LLC. No ownership rights are transferred to users.
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability.
To the fullest extent permitted by law, MinMax Technology LLC and its owners, employees, contractors, affiliates, and agents shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, lost profits, lost revenue, lost data, or business interruption arising from use of the Service. The Company's total liability shall not exceed the total subscription fees paid by you during the twelve (12) months immediately preceding the event giving rise to the claim.
You agree to defend, indemnify, and hold harmless the Company from claims, damages, liabilities, costs, and expenses arising from your use of the Service, your violation of these Terms, or your violation of applicable law.
The Company may suspend or terminate accounts at its discretion for violations of these Terms, abuse of the Service, fraudulent activity, or other conduct that threatens the integrity of the platform.
These Terms are governed by the laws of the Commonwealth of Pennsylvania. Any dispute shall be resolved through binding arbitration in Pennsylvania to the fullest extent permitted by law, and each party waives any right to participate in a class action.
The Company may update these Terms from time to time. Continued use of PitchIQ after revised Terms are published constitutes acceptance of the updated Terms.
